ARTICLE 1 – General Information

CITIA is a Public Cultural Cooperation Establishment, of which the headquarters are located at: c/o Conservatoire d’art et d’histoire – 18 avenue du Trésum – 74001 Annecy, France, registered at the RCS d’Annecy (French Trade & Companies Register) under the No. 489 885 111.

CITIA (hereinafter "the Organizer") organizes the Annecy International Animation Film Festival (hereinafter the "Festival") and the International Animation Film Market (hereinafter the "Mifa").

The Festival is the global reference for animation film and propose numerous screenings (films in or out of competition).

The International Animation Film Market is the key global rendezvous for film animation industry professionals, in terms of coproduction, purchases, sales, funding and distribution.

The accreditation procedure is mandatory to access and participate at the Festival and the Mifa organized by CITIA (hereinafter the "Events").

The Events take place over the course of a week from 14th to 19th June 2021, online via Connected Areas. These are represented by:

The online offer will not give access to the entire Official Selection. The Feature Films, TV Films and VR Works in competition will only be available on-site.
Exceptionally, due to the rights holders’ requirements, some films may not be accessible in certain territories, or may see their access limited to a maximum number of views.

"Participant" means any person, natural or legal person, accredited by the Organizer and having the right, as such, to access and participate in all or a part of the Events online (cf. art 6).

In 2021, the number of accreditations sold will be limited. The Organizer reserves the right to close the sale of one or several types of accreditations if the fixed limit is reached. 

ARTICLE 2 – Provisions Relating to the Current General Sales Conditions

2.1 Availability and enforceability of the general sales conditions (hereinafter the "GSC")

The GSC are available to participants on the Organizer’s website where they can be viewed directly.

Validation of the accreditation request by the applicant’s confirmation, in the conditions presented in Article 3 of the current GSC, represents the Participant’s adhesion to the GSC.

2.2 Articulation of the GSC with the connected areas general terms and conditions of use (hereinafter the "GTCU")

The use of Connected Areas is also subject to full agreement of the GTCU, available at the following address: https://www.annecy.org/legal-information-and-gcu

In the event of any contradiction between the Connected Areas’ General Terms and Conditions of Use and the current General Sales Conditions, the latter will take precedence.

2.3 Modifications

The Organizer reserves the right to modify the current GSC at any time by publishing a new version on the website. The GSC applicable are those in force on the validation date of the request for accreditation.

ARTICLE 3 – Accreditation Conditions 

The purpose of these General Terms and Conditions is to determine the accreditation conditions and the conditions in which professionals have access to these services online services.  

3.1 Moviegoers Online Accreditation

The Moviegoers Online accreditation is open to anyone.

3.2 Festival+ Online Accreditation

This accreditation is intended for professionals and teachers in the field of film, television and multimedia.

3.3 Mifa Online Accreditation

The Mifa Online accreditation is for all animation film, television and multimedia industry professionals and teachers, authors, directors, producers, buyers, distributers.

3.4 Specific Accreditations

3.4.1 Buyers Online Accreditation
The Buyers Online accreditation is reserved for buyers, distributers and investors in the animation, audiovisual, multimedia or video game fields after validation from the Mifa service.

3.4.2 Journalists Online and Press Officers Online Accreditations

The Journalists Online and Press Officers Online accreditations are reserved for all media professionals (journalists, photographers, press officer, bloggers and influencers), capable of justifying their professional activity within cinema, audiovisual and multimedia fields, after validation by the Media Relations service.

3.4.3 Students Online Accreditation

The Students Online accreditation is reserved to students in the field of film, television, multimedia and journalism. When registering online each student must import proof of schooling.

ARTICLE 4 – Accreditation Procedure

The accreditation request demonstrates the participant’s definitive and irrevocable commitment to attend the Events.

Festival+ Online, Students Online and Mifa Online accreditation requests take place from 19th April 2021 online only at the following website address: https://www.annecy.org/take-part/accreditation

The applicant is required to select his/her/their profile, accreditation type, the payment method, and fill in the mandatory fields on the accreditation form.

Requests for a Moviegoers Online accreditation must be done online on the website: https://online.annecy.org
The applicant is requested to create an account and fill in the mandatory fields on the accreditation request form and proceed to online payment.

The deadline for submitting an accreditation request is midday 18th June 2021.

The Organizer examines the accreditation requests after having checked that the conditions for entitlement to the desired accreditation are met. This might constitute grounds for rejection, permanent or temporary, if there is incomplete communication of the required documents, non-payment or any other legitimate reasons, such as the existence of a litigation with CITIA.

The accreditation only becomes effective after the Organizer has sent the Participant’s paid invoice.
The rights resulting from the accreditation is personal and non-transferable. The accreditation does not give any right of accreditation for another event organized by the Organizer.

4.1 Special Procedures

4.1.1 Journalists and Press Officers Online Accreditations (cf. art 3.4.2)

Journalists and photographers must include a copy of their valid press card and confirmation from their editor justifying their major articles in the field of cinema, audiovisual and multimedia executed in the last 2-years (PDF format).

Bloggers or influencers must also include a screen shot of their statistics with a graph of visits and the number of hits of their blog/site/Facebook/Twitter/Instagram, YouTube (formats accepted: .pdf, .jpeg or .png).

Press officers must attach files and press releases related to film or the audiovisual sectors (press kits in PDF format).

4.1.2 Students Online Accreditation (cf. art 3.4.3)

Students must attach proof to their accreditation form online with the following details:
-    Student’s full name,
-    Name of the school,
-    Name of the course,
-    Current school year.

Students who are registered to an online course can benefit from this accreditation under the same conditions.

ARTICLE 5 – Financial Conditions

5.1 Prices and Terms of Payment

Accreditation prices are detailed at this address: https://www.annecy.org/take-part/accreditation

Moviegoers Online: 16.67 VAT not incl.
Festival + Online: 41.67 euros VAT not incl.
Students Online: 25 euros VAT not incl.
Mifa Online: 341.67 euros VAT not incl.

The Online formula accreditation prices are listed without VAT included.
The VAT must only be added for businesses in France and European businesses without an intracommunity tax number (application of the VAT in force in each country).

Payment is to be made in full, in a single payment within 7 days of the order being finalised (except for an applicant using a purchase order).

The following secured payment methods are accepted:
For the Moviegoers Online accreditation:
Credit card: Visa, Mastercard

For the other online accreditations:

  • Credit card: Visa, Mastercard, EuroCard, Electron (Amex not accepted)
  • Bank transfer to the following account indicating the order number:
    IBAN: FR76 1680 7000 8231 3105 3721 801 / BIC : CCBPFRPPGRE

For applicants using purchase orders, they must be sent by e-mail to the following address: facturation@citia.org. On receipt, the applicant will receive an invoice on the CHORUS platform indicating the payment deadline.

For the Moviegoers Online accreditation, invoices will be sent automatically by e-mail after purchasing the accreditation.

For all the other Online accreditations, the corresponding invoices for accreditations ordered will be available in the Client’s tracking page. The link to this page will be sent by e-mail.

5.2 Late Payment Charges

In the event of late payment, the Participant will be liable to late payment charges (Article L441-6) at a rate equal to three times the interest rate at the legal rate of the price (VAT incl.) on the invoice, which will begin to run the day after the due date indicated on the invoice. These late payment charges will automatically and legally by acquired by the Organizer, without any formalities or prior formal notice.

5.3 Cancellation Request

5.3.1 Cancellation and Refund

Any cancellation request from the Participant must be sent by e-mail to the Organizer to this address: accreditation@citia.org. Refunds will be paid after the Event.

The Participant benefits from a cancellation withdrawal period of 14 days after the purchase date, during which the accreditation can be entirely refunded.

Beyond 14 days, a 20% handling fee of the accreditation price (VAT incl.), will incur.

However, if the Participant views an event or a screening online (whether within the 14-day cancellation period or not) he/she/they will have expressly used the benefits of his/her/their accreditation and consequently waivers the right to cancellation. The Annecy 2021 accreditation will be automatically provided and the Participant will not be able to cancel it. No refund will be made.

Furthermore, no refund request will be accepted from 14th June 2021 onwards.

5.3.2 Cancellation and Transfer

The Participant can cancel his/her/their participation and ask to transfer the accreditation to a third party. The original accreditation will be deleted. The new beneficiary will receive their accreditation under their own name.

It will not be possible for the latter to change the type of accreditation.

Any cancellation and transfer request by a Participant must be sent via e-mail to the Organizer at the following address: accreditation@citia.org before 14th June 2021.

This option is not valid for a Moviegoers Online accreditation. Only full cancellation of the accreditation is possible.

5.3.3 Changing the Accreditation Type

Any request to change the accreditation type results in its cancellation and refund.  
The Participant must proceed to purchase the chosen new accreditation. The actions (reservations, appointments made, etc.) carried out in the connected tools will automatically be deleted.

Any cancellation request must be sent to the Organizer via e-mail to the following address: accreditation@citia.org before 14th June 2021.

ARTICLE 6 – Access to the Connected Areas

6.1 Overview

The Platform to which the Participant has access after confirmation of his/her accreditation is available at this URL address: https://online.annecy.org

The Participant (except Moviegoers Online accreditation holders) also has access to the website: https://www.annecy.org/network:en that enables access to the Festival Network.

The website https://www.annecy.org/home is published by: CITIA, Public Institution for Cultural Cooperation (EPCC), its headquarters are at c/o Conservatoire d’art et d’histoire, 18 avenue du Trésum, 74001 Annecy, registered at the RCS Annecy, under the number 489 885 111.

The https://www.annecy.org/home website is hosted by the company Amazon Web Services:

These servers are physically located in Ireland in the European Union.

The https://www.annecy.org/home Platform is hosted by: the company KAEMO, a simplified joint-stock company, with a capital of €40,161 and its headquarters at CS 36204 – 5 boulevard Vincent Gâche – 44262 Nantes Cedex 2, registered at the Nantes RCS, under the number 811 117 894.  

These servers are physically located worldwide, and guarantee the security and confidentiality requirements in accordance with the applicable legislation concerning protection of personal data.

In the context of the current GSC, the Participant must conform to the Connected Areas’ GTCU. In the event of non-compliance to these GTCU, he/she will be subject to the sanctions there within.

6.2 Technical Conditions for Accessing the Connected Areas

The technical conditions for accessing the Connected Areas are detailed in the GTCU.

ARTICLE 7 – The Organizer’s Content and Material

The Organizer provides the Participant with programmes and websites dedicated to the Events.

The Organizer is the owner and publisher of this material, publishes them and ensures distribution, with the exception of content published by Participants on the host’s online community. This media is protected and as such the Participant may not use them in any way whatsoever without prior written consent by the Organizer.

All texts, videos, images, distinctive signs, data, applications or software features published on the Organizer’s media with the exception of those submitted by the Participant, are the property of the Organizer. As such, the Participant may not and must not under any circumstances reproduce, delete, distribute, grant and/or use them, fully or partially, in any way whatsoever, without the Organizer’s or the rights holders’ prior written consent, at the risk of being held liable.

ARTICLE 8 – Postponement or Cancellation of the Event

The Organizer reserves the right to postpone or cancel the Event, upon the occurrence of a force majeure or an unforeseeable change in circumstances. The Organizer will immediately notify the Participants.

The sums collected by the Organizer will be returned to the Participants without the possibility of claiming any additional compensation.

Considered as cases of force majeure:

Developing situation, sanitary, climatic, economic, political or social, at a local, national and international level:

  • not reasonably foreseeable at the time of communication of the Event to the Participants;
  • beyond the Organizer’s control;
  • and which, either makes the Event impossible to host, or entails the risk of disturbances or disorders likely to seriously affect the organization and smooth running of the Event, or the security of the property and persons.

If the hindrance is temporary, the fulfilment of the obligation is suspended unless the resulting delay justifies termination of the contract. If the hindrance is permanent, the contract is automatically terminated and the parties are released from their obligations under the conditions provided in Articles 1351 and 1351-1 of the Civil Code.

ARTICLE 9 – Intellectual Property Rights

9.1 Intellectual property rights for the Connected Areas

The Events and tools provided in the Connected Areas are protected under French Intellectual Property Code for France and/or worldwide.

In accordance with the provisions of the French Intellectual Property Code, use is strictly private and personal, limited to the family circle is authorized with the exclusion of any other use.

Any other use, except with the Organizer’s prior authorization and/or other rights holders, constitutes an infringement and is sanctioned under Intellectual Property.

9.2 Intellectual property rights concerning content produced by the Organizer as part of the Festival

Within the context of the Festival, the Organizer is required to create content such as live conferences (hereinafter the "Content").

The Content therefore created by the Organizer in the context of the Festival is protected by the laws in force under Intellectual Property.

It is the full and entire property of the Organizer or its partners. Any reproduction, representation, use or adaptation, in any form whatsoever, and in particular any capturing, recording, photography, disclosure of all, or part, of these elements, without the publisher’s prior written consent, is strictly prohibited. The fact for the publisher not to initiate proceedings upon becoming aware of these unauthorized uses does not constitute acceptance of said uses and the waiver of prosecution.

ARTICLE 10 – Data Protection – Collection and use of Data

The Participants are informed that CITIA, as Events Organizer and responsible for the processing as defined by the amended Act of 6th January 1978, collects, processes and stores personal data that concerns them to enable their participation at the Events.

The Participants agree to provide the Organizer with the following personal data deemed indispensable for their registration, to their participation at the Events and to access the Connected Areas:
Title, first name, last name, country of residence, mobile phone number, personal e-mail address, photo, profession.
The Participants may also expressly consent to receiving information from the Organizer and/or its partners by ticking the box provided for this purpose when logging in for the first time onto their Annecy Network.
The personal data collected are strictly intended for the Organizer, their service-providers, their partners and to the Participants for the sole purpose of achieving the intentions set out above.

The sub-contractors, service-providers, partners and other Participants are required to respect the confidentiality and security of the personal data and only use them in the context of carrying out their mission as sub-contractor and service-provider. The Organizer guarantees the Participants that their personal data thus collected will not be disclosed to any unauthorized third parties without their prior consent. The Participants’ personal data are conserved by the Organizer for the necessary length of time to achieve the purposes for which they were collected, and in any event within a 3-year limit after the last contact.

In accordance with the legislation and the regulations in force, the Participants benefit from a right of access and rectification, a right to refuse on legitimate grounds, a right to erase and limit personal data, and a right to define guidelines on the fate of personal data after their death.

They also benefit from a right to data recovery and portability in the cases provided for by law. To exercise their rights they are required to write to the Data Protection Officer (DPO) by e-mailing to: dpo@citia.org or by letter to this address: DPO, CITIA c/o Conservatoire d’art et d’histoire – 18 avenue du Trésum CS 50038 – FR-74001 Annecy Cedex. They also have the right to lodge a complaint with the French Data Protection Authority (CNIL).

ARTICLE 11 – Non-compliance and Sanction

Any breach of the provisions of these current general terms and conditions will result in the immediate (temporary or permanent) suspension of the Participant’s accreditation, without any refund for the accreditation or any other sum that the Participant will have paid to the Organizer.

In any event, once a breach committed by the Participant has been confirmed, the Organizer will have the right to terminate the accreditation contract without summons or formalities, without prejudice to compensation that may be reclaimed by the Participant.

ARTICLE 12 – Election of Jurisdiction and Applicable Law

By express agreement between the parties, the current terms and conditions and the resulting transactions are governed by French law.  

In the event of difficulty concerning the interpretation of this present document, only the French version of these Regulations is authentic.

In the event of a dispute, the parties prioritize implementation of an amicable resolution from the Organizer prior to referral to the Courts.

Any disputes to which the current general terms and conditions and resulting agreements could give rise, regarding validity, interpretation, execution, resolution, consequences and their aftermath, will be submitted to the competent courts of Annecy.
